UAE Announces 2-Month Grace Period for Residence Visa Violators

A Significant Opportunity For Those Violating Their Residence Visa Terms

Starting September 1, 2024, the UAE authorities will offer a two-month grace period for residence visa violators to have their fines waived. This initiative aims to allow violators to either regularize their status or leave the country without facing financial penalties.

The Federal Authority for Identity, Citizenship, Customs, and Port Security (ICP) stated that this grace period aligns with the Federal Law on the Entry and Residency of Foreigners. This initiative reflects the UAE’s values of compassion and tolerance by offering residence visa violators an opportunity to rectify their legal status. During this period, the ICP will implement measures to waive fines and legal consequences, making it easier for violators to adjust their status or exit the country.

The validity of residence visas in the UAE varies depending on the type and sponsor. Sponsored visas typically last for 1, 2, or 3 years, while self-sponsored visas can be valid for up to 5 or 10 years—failure to renew or leave the country before the visa expires leads to fines. In 2023, overstay penalties were standardized to Dh50 per day.

TME Legal Takeaway

This grace period provides a significant opportunity for those violating their residence visa terms to address their status without financial burden. The ICP will soon announce detailed procedures for this amnesty, ensuring that affected individuals understand how to take advantage of this leniency. This initiative highlights the UAE’s commitment to managing its residency regulations with a balance of firmness and compassion, providing residents and expatriates with clear pathways to compliance.

Judicial Shift in UAE Labour Law – Limitation Period for Annual Leave Claims

A recent judgment by the Abu Dhabi Court of Cassation (Case No. 73/2024) marks a notable departure from previous case law by ruling that the limitation period for claiming accrued leave entitlements does not automatically commence at the end of each year of service. Rather, the burden is on the employer to prove that the employee either took the leave or forfeited it with knowledge of the consequences. This decision significantly impacts leave management practices in the UAE and underscores the importance of accurate recordkeeping and timely enforcement of internal HR policies. For employers, the case serves as a strong reminder to proactively monitor and document annual leave usage.
